These Terms and Conditions ("Terms") govern your access to and use of the YUGA mobile application (the "App") provided by Hexacodes ("we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
YUGA is a yoga and wellness application that provides guided classes, programs, personalized plans, progress tracking, and related content.

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority where you live, you may use the App only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
By using the App, you represent that you meet these requirements and that the information you provide is accurate.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on devices you own or control.

The App currently operates without mandatory user registration. Your preferences, progress, and related data are primarily stored locally on your device.
You are responsible for maintaining the security of your device. We are not responsible for loss of locally stored data due to device loss, damage, reset, or uninstallation.
YUGA offers a free tier with access to selected classes, programs, and plan content. Free access limits may change at our discretion.
Premium features require an active paid subscription ("Premium" or "Subscription"). Premium may include, among other things:

By purchasing a Subscription, you agree to the applicable store's terms and payment policies. All billing, renewals, cancellations, refunds, and payment disputes are handled according to the rules of the platform through which you subscribed, except where applicable law requires otherwise.
We use Adapty to manage subscriptions and validate access. We do not process payment card information directly.
Unless cancelled before the end of the current billing period, Subscriptions automatically renew at the then-current price for the same duration unless otherwise stated at purchase.
You can manage or cancel your Subscription through your Apple ID or Google Play account settings.
If offered, free trials or promotional pricing convert to a paid Subscription unless cancelled before the trial or promotional period ends. Eligibility for promotions is determined by the app store and may vary.
You may restore previously purchased Subscriptions using the in-app "Restore Purchases" option, subject to the policies of Apple or Google and verification through Adapty.

To the fullest extent permitted by law, Hexacodes is not liable for any injury, loss, or damage arising from your use of the App or reliance on its content.

We may suspend or terminate access to the App if we reasonably believe you have violated these Terms.
The App and all content within it—including but not limited to text, graphics, logos, images, audio, video, software, class structures, program designs, and branding—are owned by Hexacodes or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, publish, transmit, or create derivative works from App content except as expressly permitted by these Terms or with our prior written consent.
"YUGA" and related marks are trademarks of Hexacodes. Unauthorized use is prohibited.
The App integrates with third-party services, including:
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services or content.
The App may also link to external websites. We do not control and are not responsible for external sites.
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the practices described in the Privacy Policy.
We strive to keep the App available and up to date, but we do not guarantee uninterrupted or error-free operation. We may:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will meet your requirements, be accurate, complete, or reliable, or that defects will be corrected.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEXACODES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:

You agree to indemnify, defend, and hold harmless Hexacodes and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
You may stop using the App at any time by uninstalling it and cancelling any active Subscription through your app store account.
We may terminate or suspend your access to the App immediately, without notice, if you breach these Terms or if we discontinue the App.
Sections that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, and governing law—will survive.
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where Hexacodes is established, without regard to conflict of law principles, except where mandatory consumer protection laws in your country of residence require otherwise.
If you are a consumer in the European Union or another jurisdiction with mandatory local consumer rights, nothing in these Terms limits your statutory rights.
Before initiating formal legal proceedings, you agree to contact us at info@hexacodes.net and attempt to resolve the dispute informally within 30 days.
If informal resolution fails, disputes shall be resolved in the courts of competent jurisdiction as determined by applicable law, unless mandatory consumer law in your jurisdiction provides otherwise.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this document. Material changes may be communicated through the App or other reasonable means.
Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the App and cancel any active Subscription.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with the Privacy Policy and any purchase terms presented at the point of sale through Apple or Google, constitute the entire agreement between you and Hexacodes regarding the App and supersede any prior agreements on the same subject.
